For a list of sources and search possibilities, please go to the Media tab, on the POS 2041 Lib page. You may also use the Internet (i.e. Google) to find a relevant article for this assignment. After reading the article and the chapter about civil liberties, address each of the elements below.

    1. Summary – Summarize in paragraph form the facts and issues presented in the article. Document the source of your information with a parenthetical reference, i.e. (Sanger and Broad 2019, para. 4).
    2. Application – Apply three or more concepts from the assigned chapter to the main ideas in the news article. Specifically explain how the material in your textbook is illustrated in the article you are examining. Similarly, Biskupic states that legal experts emphasize that the measures put in place should be reasonable, applicable to all citizens, and fair (Biskupic, 2020, para. 4).

She discusses the legality of quarantine measures and the extent to which these measures should not interfere with or affect human rights. She further states the various legal challenges that have emerged, including lawsuits regarding the classification of services as essential or non-essential and concerns about the treatment of people in quarantine zones (Biskupic, 2020, para. 6). The article concludes by asking the federal government to balance between protecting public health and conserving civil liberties during the pandemic.

Three concepts from Chapter 4 relevant to the article’s main ideas include freedom of movement, the right to fairness and equal treatment, and privacy. This relates to the concept of freedom of movement and travel that has been sensibly acknowledged as an essential constitutional right under the Fifth Amendment (Krutz, 2019, p. 116). It offers an overview of the contradictory views of government measures and civil liberties advocates who are against extreme measures. By presenting the various legal challenges, the article encourages readers to consider the implications of civil liberties in times of crisis.

From my observation, it is clear that protecting public health during times of crisis without affecting individual rights is challenging. Nonetheless, the government and policymakers should try to balance the two. The liable bodies must do their best to ensure that civil liberties are upheld, even during times of crisis, and that any measures implemented are justified, temporary, and subject to regular review.
